Myths or realities: the Highway Code

The Quebec Highway Code contains approximately 700 articles of law. Although all licensees have had to study it vigorously in order to obtain their license, it is difficult to remember if some of the laws are myth or reality. The good weather is just around the corner and a review is in order.

Is it legal to carry a mattress (or similar sized object) on the roof of a car?
Yes. However, according to section 442, no object may obstruct the driver's vision. Also, if a police officer notices that the object is improperly attached, that it is moving or that it compromises the stability of your vehicle, he or she is entitled to issue you a ticket. The fine ranges from $30 to $60.

2. Is it legal for men to drive shirtless?
Yes. There is no article that addresses the dress code for motorists.

3. Is it legal to be intoxicated in a car that is not running?
No. In Quebec, it is illegal to drive, have care or control of a vehicle while impaired. You cannot be in a situation that suggests that you will eventually drive the vehicle (even if you are not in the driver's seat). The law also applies if you have the keys to a nearby vehicle and have access to it. As a result, you could be fined at least $1,000 and have your licence suspended.

4. Is it legal to do hitch-hiking?
No. In fact, it is illegal for a pedestrian to stand on the side of the road to solicit transportation or to talk to a driver. In addition, it is illegal for a motorist to stop his or her vehicle on the roadway of a public road where the minimum speed limit is 60 km/h.
